The background

A routine handover became a business-critical dispute

A retail business took occupation of two commercial premises previously occupied by another trading company. The incoming occupier needed the electricity accounts put into its own name and future usage billed correctly.

The Change of Tenancy was intended to establish the new occupier’s responsibility while leaving historical liabilities with the outgoing business. Shortly after occupation, substantial historic debt emerged on the electricity accounts.

One account alone carried arrears exceeding £33,000.

The supplier and its debt recovery agents were pursuing balances accumulated before the new occupier took possession.

What made the case complex

More than an account name change

The tenancy application, historic balances and continued electricity supply all needed attention while the dispute remained unresolved.

Rejected application

The supplier initially rejected the legitimate Change of Tenancy application, alleging links between the outgoing and incoming businesses.

Disputed liability

Balances from before the new occupation complicated the handover. Establishing the incoming business’s position was central to resolving the accounts.

Disconnection risk

Debt recovery agents began pursuing enforcement action and potential disconnection. Formal communications indicated recovery proceedings could progress.

Our response

Challenging the decision. Working towards resolution.

We coordinated evidence, managed the complaint process and negotiated a commercial resolution, with the immediate risk to the business firmly in view.

    Manage

We managed the complaint process while enforcement and disconnection remained concerns.

  4. 04

    Negotiate

We negotiated a commercial settlement that enabled the matter to reach resolution.

The outcome

Electricity stayed on. The business could move forward.

The case concluded with a negotiated settlement and successful processing of the Change of Tenancy. The electricity supplies were released, allowing the business to move supplies without interruption.

This was a commercial resolution to a complex dispute, with continuity of supply a crucial part of the result.

Practical guidance

Taking over premises? Keep a clear record.

A well-documented handover can help separate previous occupation from your business’s energy use. These are useful preparations for any commercial tenancy change.

Record the handover

Keep your tenancy documents, occupation date, meter serial numbers and dated opening meter readings together.

Check the accounts

Check the business name, supply address and billing dates. Ask the supplier to explain any balance that relates to a period before your occupation.

Act on warnings

Keep enforcement notices and complaint references. Raise urgent concerns promptly and ask for written confirmation of the supplier’s position.

A tenancy change is not the same as installing a new supply. If your premises need a connection, read our new business energy connection guide.

Business energy questions

From disputed accounts to everyday usage

Understanding who is responsible for an account is the first step. Understanding what your business uses helps you plan what comes next.

What is a Change of Tenancy?
A Change of Tenancy records a change in the business occupying a property. It helps the energy supplier establish the incoming occupier’s account and the date from which its usage should be billed. It is different from simply choosing a new tariff.
Does raising a dispute automatically stop disconnection?
Do not assume that a complaint has paused enforcement. In this case, potential disconnection remained a concern while the dispute was unresolved. Contact the supplier promptly, explain the disputed position and request written confirmation of any hold on action.
How is an erroneous transfer different?
An erroneous transfer concerns a supply moving to another supplier in error, rather than a change in the occupier. We have also resolved an erroneous transfer dispute for Dessert Island. If your supply appears to have switched unexpectedly, keep the relevant correspondence and ask for the transfer to be investigated.
How much energy does a small business use?
Usage depends on your premises, opening hours, equipment and heating or cooling needs. Review a full year of consumption in kWh where possible, rather than comparing bill totals alone. Once your account is correct, we can help you compare business energy using your actual requirements.
Can AI use affect a business’s electricity consumption?
AI workloads use computing power, but the effect on your premises depends on where that computing happens. Equipment running locally draws electricity on site; cloud-based processing happens in external data centres. For your own energy budget, track local equipment use and cooling needs rather than assuming a fixed energy cost per AI task.
